A United States court has dismissed the case against Olalekan Ponle, a Nigerian big boy popularly known as Woodberry, accused of multi-million dollar wire fraud.

Woodberry was extradited to the United States after his arrest alongside Hushpuppi in the United Arab Emirate on June 10, for multiple fraud charges after a raid by operatives of the Dubai crime unit.

According to Premium Times, the United States government on June 20 filed a motion through its attorney, John R. Lausch, requesting that the case against Mr Ponle should be dismissed without prejudice.

The complaint against Woodberry claims an unnamed Chicago company was tricked into sending wire transfers totalling N5.8 billion. Companies based in Iowa, Kansas, Michigan, New York and California also were victims of the fraud, prosecutors say.

Woodberry’s dismissal which is without prejudice is described as temporary as the prosecutor can refile the case within a certain period of time.The probable causes of dismissal range from unavailability of sufficient evidence, an improper criminal complaint or charging document, to loss of evidence necessary to prove the defendant committed the crime.

This comes shortly after he employed the services of a top Chicago’s lawyer, Michael Nash, to defend him in court.

The 29-year-old seemed to have taken the footsteps of his partner in crime, Hushpuppi, who also employed the services of a top Chicago lawyer to defend him in court.
